Billy Go – Terms of Service

Welcome to Billy Go. These Terms of Service ("Terms") govern your use of the Billy Go application, services, route-processing services, and related tools (collectively, the "Service"). By accessing or using Billy Go, you agree to be bound by these Terms.

1. Overview of Service

Billy Go provides a cloud-based service that converts third-party, state-issued permit routes into GPS-navigable routes.

Billy Go may offer more than one method of route processing, including:

  • Self-Service: A service mode in which the User enters, selects, confirms, or otherwise processes permit-routing information through the Service.
  • Full Service: A service mode in which the User submits a state-issued permit to Billy Go and Billy Go processes the permit into a GPS-navigable route on the User's behalf.

Billy Go may enable, disable, modify, or discontinue particular service modes from time to time.

The App is licensed, not sold, and you receive no ownership interest in any software, database, routing system, or underlying technology.

For purposes of these Terms, the terms "Driver" and "User" are interchangeable. The use of one term rather than the other does not create, reduce, expand, transfer, or otherwise alter any duty, responsibility, obligation, or liability under these Terms. Any duty, responsibility, obligation, or liability assigned to a Driver applies equally to a User, and vice versa.

2. Scope of Use & Permit Adherence

  • Permit-only routing: The Service is strictly for state-issued permit routes. Permits must be issued by the appropriate governmental authority and must be valid for the applicable vehicle, load, movement, date, and jurisdiction at the time of use.
  • Permit controls: The state-issued permit is the controlling authority at all times. A GPS route created through Billy Go does not replace, modify, amend, supersede, certify, or reinterpret the permit.
  • Not a general routing app: Billy Go is designed exclusively for permit-based routing. It is not a general truck-routing or navigation application and must not be used as such.
  • Supplemental tool only: Billy Go is a supplemental navigation and permit-processing tool. Use of the Service does not transfer responsibility for the permitted movement from the User to Billy Go.
  • No safety clearance guarantees: Billy Go does not independently determine or guarantee bridge heights, weight limits, roadway dimensions, physical clearances, load suitability, or roadway capacity. The permit and applicable legal requirements remain controlling.
  • No condition guarantees: Billy Go makes no representations or guarantees regarding traffic, weather, construction, temporary closures, emergency conditions, road conditions, mislabeled roads, changes in roadway configuration, or hazards of any kind.
  • No load guarantees: Billy Go makes no representations or guarantees regarding the size, weight, dimensions, configuration, legality, or compliance of any vehicle or load.
  • Independent judgment required: The User must follow all posted signs, permit restrictions, road conditions, traffic controls, law-enforcement instructions, escort requirements, and applicable laws regardless of any route displayed in the Service.

3. Self-Service and Full Service Processing

Routes may be created through Self-Service or Full Service.

Self-Service

When Self-Service is available, the User is responsible for entering, selecting, reviewing, and confirming permit-routing information through the Service.

Billy Go processes the information supplied or confirmed by the User into navigational guidance. Billy Go is not responsible for errors resulting from inaccurate, incomplete, or incorrectly entered information.

Full Service

Under Full Service, Billy Go processes the state-issued permit submitted by the User and converts the permit route into a GPS-navigable route.

Billy Go will use reasonable efforts to accurately process the permit submitted. However, Full Service does not constitute a guarantee that the resulting GPS route is free from error, omission, ambiguity, or other inaccuracy.

Full Service does not transfer to Billy Go responsibility for:

  • verifying that the permit was properly issued;
  • confirming that the permit applies to the correct vehicle or load;
  • confirming that the permit remains valid at the time of movement;
  • independently selecting a legal route;
  • inspecting roadway conditions;
  • independently verifying bridge heights, load limits, clearances, or roadway suitability;
  • ensuring compliance with escort, curfew, weather, travel-time, or other permit restrictions; or
  • operating the vehicle in accordance with the permit and applicable law.

Billy Go is processing the route contained in the permit submitted by the User. Billy Go is not independently choosing or certifying a lawful route for the vehicle or load.

4. Permit Submission Requirements

For Full Service processing, the User is responsible for submitting a complete, current, accurate, and legible copy or image of the applicable permit.

The submitted permit must contain sufficiently clear and readable text to allow Billy Go to process the route.

The User is responsible for ensuring that the submission includes all information necessary to process the permit correctly, including, where applicable:

  • all permit pages;
  • continuation pages;
  • route instructions;
  • travel restrictions;
  • attachments;
  • special conditions;
  • amendments; and
  • other materials affecting the permitted route.

Billy Go is entitled to rely on the permit and information actually submitted by the User.

The User remains solely responsible for submitting the correct permit and for confirming that the permit is valid and not expired.

If an incorrect, expired, incomplete, inaccurate, illegible, or otherwise defective permit is submitted, the User remains responsible for all consequences resulting from that submission.

5. Permit Changes, Amendments & Revisions

A GPS route created through Billy Go reflects the permit information available to Billy Go at the time the route is processed.

Changes occurring after processing are not automatically reflected in the GPS route.

This includes, without limitation:

  • permit amendments;
  • replacement permits;
  • revised routes;
  • extensions;
  • expiration;
  • cancellation;
  • updated restrictions; and
  • other changes made by the issuing authority.

If a permit changes after Billy Go has processed the route, the User is responsible for submitting the changed or replacement permit for additional processing.

The User must not assume that a previously processed GPS route reflects a later amendment or revision to the permit.

6. Route Acknowledgment & User Responsibility

  • Mandatory verification: The User must review and confirm every route created through the Service before operating the vehicle, regardless of whether the route was created through Self-Service or Full Service.
  • Detailed confirmation requirement: The User must compare the GPS route against the applicable state-issued permit and verify that the intersections, road segments, turns, and instructions displayed by Billy Go accurately reflect the permit.
  • User responsibility: The User is solely responsible for determining that the GPS route accurately corresponds with the state-issued permit before beginning or continuing the permitted movement.
  • Full Service does not eliminate verification: A route processed by Billy Go personnel through Full Service must still be independently reviewed and confirmed by the User.
  • Processing errors: Billy Go may make errors in processing permit information. The User's obligation to verify the route applies even when Billy Go performed the route processing.

YOU MUST PERSONALLY VERIFY THAT THE GPS ROUTE MATCHES THE STATE-ISSUED PERMIT BEFORE OPERATING YOUR VEHICLE. FULL SERVICE DOES NOT ELIMINATE THIS REQUIREMENT. YOU MAY NOT RELY ON BILLY GO AS A SUBSTITUTE FOR REVIEWING AND FOLLOWING THE STATE-ISSUED PERMIT.

The Service may require explicit acceptance or acknowledgment of a route. By accepting, using, or navigating with a route, the User acknowledges responsibility for verifying that the route matches the permit.

7. Deviation from Permit Route

If the User departs from the state-issued permit route for any reason, including:

  • a missed turn;
  • incorrect navigation;
  • failure to follow the permit;
  • failure to verify the GPS route;
  • a Self-Service entry error;
  • a Full Service processing error;
  • roadway conditions;
  • construction;
  • law-enforcement direction; or
  • any other circumstance,

Billy Go does not provide or guarantee rerouting, corrective navigation, or alternative routing guidance.

Any deviation from the permitted route remains the responsibility of the User.

The User is responsible for determining the lawful and appropriate course of action following a deviation, including compliance with all applicable laws, permit requirements, company policies, law-enforcement instructions, and safety requirements.

Billy Go provides no assurance that an alternative route displayed by another navigation system, mapping service, dispatcher, or other source is authorized for the permitted movement.

8. Processing Times, Submission Cutoffs & Service Targets

Billy Go may publish or display submission cutoff times, expected processing windows, and target delivery or completion times for Full Service processing.

Current cutoff times and processing targets may vary based on location, time zone, operating schedule, service availability, or other factors and may be changed from time to time.

Published or displayed processing times are service targets and estimates only and are not guarantees.

Billy Go will use reasonable efforts to complete route processing within the applicable target time, including when a submission is received after a published cutoff. However, submissions received after the applicable cutoff may require additional processing time.

Actual processing times may vary because of:

  • submission volume;
  • permit complexity;
  • unclear or unusual routing instructions;
  • incomplete or illegible submissions;
  • technical problems;
  • service interruptions;
  • the need for clarification; or
  • other circumstances affecting processing.

Failure to meet an estimated processing or delivery time does not constitute a guarantee, warranty, or representation that the Service has failed to perform as agreed.

9. Unprocessable Permits & Reprocessing

Billy Go may decline, pause, or discontinue processing when a permit cannot reasonably be processed.

This may include permits that are:

  • illegible;
  • incomplete;
  • internally inconsistent;
  • missing required information;
  • ambiguous;
  • damaged or corrupted;
  • unsupported by the Service; or
  • otherwise unsuitable for reliable processing.

If Billy Go determines that a permit cannot be processed, Billy Go will issue a cancellation order and provide notification that the permit could not be processed.

If the inability to process the permit results from an incomplete, incorrect, illegible, expired, or otherwise defective submission, the User may be required to submit a corrected permit for reprocessing.

Billy Go may establish procedures, fees, credits, or other rules governing corrected submissions and reprocessing.

10. User Input Accuracy

The User agrees to provide complete, accurate, legible, and current information when using the Service, including permit details, dates, expiration information, routing data, GPS coordinates, mileage, and other information required for route processing.

The User is solely responsible for ensuring that information submitted to Billy Go is accurate and appropriate for the intended movement.

Any alteration, omission, inaccuracy, or deficiency in submitted information that affects routing or compliance remains the responsibility of the User.

Billy Go is not responsible for consequences resulting from inaccurate, incomplete, outdated, misleading, or improperly submitted information.

11. Prohibited Conduct

You agree not to:

  • Use the Service for autonomous or high-risk vehicle control;
  • Use Billy Go as a substitute for possession, review, or compliance with the applicable state-issued permit;
  • Reverse engineer, decompile, or attempt to extract source code;
  • Use the Service or its data to build competing products; or
  • Scrape, copy, distribute, or misuse data outside the intended use of the Service.

12. Warranty Disclaimer

To the maximum extent permitted by law, the Service, including Self-Service and Full Service processing, is provided "as is" and "as available."

Billy Go disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Billy Go does not guarantee that:

  • a processed route will be free from error or omission;
  • routing data will always be accurate, complete, or current;
  • the Service will always be available or uninterrupted;
  • processing will always be completed within a published target time; or
  • real-world conditions will correspond with the permit or GPS route.

Real-world conditions may differ materially from information available through the Service.

13. Comprehensive Indemnification

To the fullest extent permitted by law, the User agrees to defend, indemnify, and hold harmless Billy Go and its affiliates, officers, employees, contractors, agents, and service providers from third-party claims, damages, liabilities, costs, or losses, including reasonable attorneys' fees, arising from or relating to:

  • use or misuse of the Service;
  • failure to review or verify a GPS route against the state-issued permit;
  • deviation from a permitted route;
  • accidents, collisions, property damage, injuries, or other vehicle-related incidents;
  • violations of permits, laws, regulations, or governmental requirements;
  • fines, penalties, citations, enforcement actions, or other consequences related to routing or compliance;
  • submission of an incorrect, incomplete, expired, inaccurate, or illegible permit;
  • failure to provide an amended or replacement permit; or
  • failure to comply with permit restrictions, roadway conditions, signs, or law-enforcement instructions.

This obligation applies to the fullest extent permitted by applicable law.

14. Limitation of Liability

To the fullest extent permitted by law, Billy Go's total aggregate liability for all claims arising out of or related to the Service, including Self-Service processing and Full Service processing, shall not exceed the total amount of fees paid by you to Billy Go during the twelve (12) months preceding the event giving rise to the claim.

Billy Go shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including:

  • lost profits;
  • lost revenue;
  • lost business opportunities;
  • business interruption;
  • delay costs;
  • towing or recovery costs;
  • fines or penalties;
  • cargo losses;
  • loss of data; or
  • other consequential economic losses,

to the fullest extent permitted by law.

Nothing in these Terms transfers responsibility for operating the vehicle, complying with the permit, remaining on the permitted route, or complying with applicable law from the User to Billy Go.

15. Data & Privacy

Billy Go may access and use certain data necessary to operate, provide, maintain, secure, and improve the Service, including device information, routing interactions, location data, permit-related inputs, route-processing information, and submitted permit materials.

By using the Service, you grant Billy Go a limited license to use this information as reasonably necessary to operate, maintain, provide, and improve the Service.

Data practices will be further described in a separate Privacy Policy.

16. Legal Terms

  • Updates to Terms: Billy Go may update these Terms from time to time. Continued use of the Service following an update constitutes acceptance of the revised Terms.
  • Service Changes: Billy Go may modify, enable, disable, suspend, or discontinue features or service modes, including Self-Service and Full Service, from time to time.
  • Arbitration: Disputes shall be resolved through binding arbitration on an individual basis, where permitted by law.
  • Governing Law: These Terms are governed by the laws of the State of Missouri.
  • Entire Agreement: These Terms constitute the full agreement between you and Billy Go regarding the Service.

17. Acknowledgment

By using Billy Go, you acknowledge and agree that:

  • Billy Go is a supplemental tool only;
  • the state-issued permit remains the controlling authority;
  • you are responsible for possessing and complying with the correct and valid permit;
  • you must personally verify every GPS route against the applicable permit before operating the vehicle;
  • Full Service processing does not relieve you of that verification requirement;
  • you remain responsible for remaining on the permitted route;
  • you remain responsible for complying with all applicable laws, permit restrictions, signs, roadway conditions, and law-enforcement instructions; and
  • use of the Service does not transfer your legal or operational responsibilities to Billy Go.
